Hundi Puhkemaja Gift Card Terms and Conditions of Purchase and Use

1. General Provisions

1.1. These Terms and Conditions govern the purchase, issuance and use of Hundi Puhkemaja gift cards.

1.2. The seller and issuer of the gift cards is Modestia Kodud OÜ, registry code 17244447 (hereinafter referred to as the Issuer).

1.3. Hundi Puhkemaja gift cards may be used to pay for services and products offered by Hundi Puhkemaja, with the exception of purchasing new gift cards.

1.4. Gift cards are divided into monetary gift cards and service-specific gift cards.

1.5. By purchasing a gift card, the purchaser confirms that they have read and agree to these Terms and Conditions.

2. Purchase and Issuance of Gift Cards

2.1. Gift cards may be ordered through the Hundi Puhkemaja website.

2.2. The purchaser selects the type and design of the gift card and, where applicable, its value, and provides the information required to place the order.

2.3. After the order has been placed, payment instructions will be sent to the email address provided by the purchaser.

2.4. Payment for the gift card must be made within seven calendar days of placing the order. The exact payment deadline will be specified in the payment instructions.

2.5. If payment has not been received by the specified deadline, the order will be subject to cancellation. If the purchaser subsequently wishes to purchase a gift card, a new order must be placed.

2.6. A digital gift card will be issued as a PDF file and sent to the email address provided by the purchaser once payment has been received and confirmed.

2.7. The purchaser is responsible for ensuring that the email address provided when placing the order is correct. The Issuer shall not be liable for delivery problems arising from an incorrect email address provided by the purchaser or from the settings of the purchaser's email account, except where liability arises under applicable law or from the Issuer's own acts or omissions.

2.8. If the gift card has not been received after payment has been confirmed, the purchaser should contact Hundi Puhkemaja.

3. Validity of Gift Cards

3.1. A gift card is valid for one year from the date of issue indicated on the gift card.

3.2. The date of issue indicated on the gift card is the date on which payment was received.

3.3. A gift card may be redeemed throughout its validity period, including on the final day of validity.

3.4. Once the validity period has expired, the gift card can no longer be redeemed under normal circumstances, and any unused value will generally not be refunded, except where required by applicable law.

3.5. In justified exceptional circumstances, the Issuer may extend the validity period of a gift card or permit its redemption after expiry.

4. General Conditions of Gift Card Use

4.1. A gift card may be redeemed using the unique code indicated on the card.

4.2. Gift cards are transferable and may be used by any person in possession of a valid gift card or its unique code.

4.3. The unique gift card code must be kept secure to prevent it from falling into the hands of unauthorised third parties.

4.4. The Issuer shall not be liable for the unauthorised use of a gift card code unless such use results from a breach of the Issuer's obligations. This provision does not limit any statutory consumer rights.

4.5. The intention to pay with a gift card must be communicated when booking a service or before completing a purchase.

4.6. The provision of services is subject to availability. A gift card does not guarantee a reservation for a particular date.

4.7. Seasonal SPA services are primarily available from May to August. Outside this period, these services are provided by prior arrangement.

5. Use of Monetary Gift Cards

5.1. Monetary gift cards may be used to pay for services and products offered by Hundi Puhkemaja, excluding the purchase of new gift cards.

5.2. A monetary gift card may be redeemed in multiple transactions until its value has been fully used or its validity period has expired.

5.3. If the value of a purchase is lower than the remaining balance of the gift card, the unused balance will remain available for future purchases during the gift card's validity period.

5.4. If the price of the selected services or products exceeds the remaining balance of the gift card, the difference may be paid using another payment method accepted by Hundi Puhkemaja.

5.5. Any unused gift card balance is not redeemable for cash, except where required by applicable law.

6. Use of Service-Specific Gift Cards

6.1. A service-specific gift card entitles its holder to a single redemption of the service specified on the card.

6.2. If the price of the specified service increases after the gift card has been purchased, the gift card holder will not be required to pay the difference.

6.3. If the service specified on the gift card is no longer offered, the gift card holder will be given the option of selecting an equivalent service or using the original purchase value of the gift card towards another service offered by Hundi Puhkemaja.

6.4. If neither an alternative service nor another proposed solution is acceptable, the matter will be resolved individually, taking into account the rights provided under applicable law.

6.5. A service-specific gift card may not be used to purchase another gift card.

7. Withdrawal from Purchase and Refunds

7.1. As a general rule, gift cards cannot be exchanged for cash or redeemed for a refund, except where required by applicable law.

7.2. The right to withdraw from the purchase of a gift card concluded by means of distance communication, and the conditions governing the exercise of that right, are determined by applicable law.

7.3. To exercise a statutory right of withdrawal, the purchaser must submit an unequivocal statement of withdrawal to the Issuer. Where a right of withdrawal applies, the amount paid will be refunded in accordance with the procedure prescribed by law.

7.4. In the event of a refund, the gift card will be cancelled and may no longer be redeemed.

7.5. The Issuer must be notified as soon as possible if a gift card is lost or has been sent to an unintended recipient. Any replacement or alternative solution will depend on whether the gift card can be identified and has not yet been redeemed.

8. Complaints and Final Provisions

8.1. Any questions or complaints relating to gift cards may be addressed to Hundi Puhkemaja using the contact details published on its website.

8.2. Complaints will be handled in accordance with applicable law.

8.3. These Terms and Conditions do not limit any statutory rights granted to consumers.

8.4. These Terms and Conditions shall be governed by the laws of the Republic of Estonia.
